Is it possible to define dominant position on the market?

This thesis aims to reveal whether it is economically meaningful to define dominant position on the market. The term "dominant position" is one of the key terms in the anti-trust legislation. Without such definition there is a significant part of the anti-trust law unfeasible. I used some cases judged by the Office for the Protection of Competition in the past ten years that involved considering dominant position issues to show how important the definition of dominant position is. On the cases it is shown that the decisions which are based on very vague basis, mostly without necessary analysis, represent the main issue of Office for the Protection of Competition. Moreover, companies are sanctioned on these questionable verdicts. The result of these issues holds that the decision making of the Office for the Protection of Competition is unpredictable and it is also dependent on different criteria than the real analysis of the market situation.
The theory of rent-seeking and the public procurement in the Czech Republic in years 1993 - 2011

The aim of this thesis is to analyze the development of legal and institutional framework of the public procurement in the Czech Republic from 1993 to 2011 and on the basis of this analysis to determine their influence on rent seeking in the public procurement. The main problems of the public procurement in the CR are also discussed in this thesis. The process of awarding and execution of the public procurement is very topical. A hundred of billions from public funds are yearly spent through the public procurement in the CR. Currently, the intense debate about the influence and importance of the public procurement act amendment are taking place. The theoretical part covers the general theory of rent seeking. The basic characteristic together with the economical aspects of the public procurement are also explained here. The analytical part is focused on the development of legal framework of the public procurement from 1993 to 2011. The main accent is put on the defining of the space for rent seeking during awarding, execution and follow-up control of the public procurement. The development of institutional framework of the public procurement arrangements in the CR, namely the activities of the Office for the Protection of Competition, the Supreme Audit Office and the Ministry of Regional Development, are defined in this part. Further, the main problems of the public procurement in the CR together with their possible solutions are described here. The thesis uses the method of comparison of the different public procurement acts which were implemented during the years 1993-2011 including the comparison of the institutional framework in order to detect the positive and negative influence on the rent seeking in the public procurement.
Possibility of the creation of the cartel agreements in the Czech periodical and non-periodical press market? Case study

The aim of this theses is to analyze the market structure of the periodical and non-periodical market in the Czech republic. Main goal is to find out, if there is a possibility of the creation of the horizontal cartels. The first part will focus on the theoretical concept of the cartel, its economic and legal consequences for the market. Practical part explore a vertical relationship in the market of periodical and non-periodical press, which is a specific market, simply because publisher determines the final price and unsold copies (remittances) buys back at a selling price. This analysis is the basis for dealing with a specific case, that have been discussed by the Office for the protection of competition on the suspicion of the coordinated action of the competitors to gain a dominant position in one part of this market in the distribution of periodical and non-periodical press. The final part examines the impact of this concrete case and its consequences on developement of this market regarding cartel agreements.
Competition policy of EU in the field of state aid

This thesis deals with competition policy in the field of state aid. The objective is to outline how the system of granting the state aid works and how the regulations are anchored in the legislation of EU. On the other hand the thesis wants to offer different points of view on the policy. The second half of the paper focuses on the Czech banking sector -- it studies the environment of late 90s and compares the positions of big bank before their privatization. The case of Komerční banka has been chosen to analyze the specific impacts of granted state aid.
